You must file an Application for No Fault Benefits within one year of the automobile accident date, otherwise your car insurance will not cover any loss.
- No matter who is at fault, your own insurance company is responsible to you for 85% of your lost wages.
- Proof of the amount of your wages must be sent to the insurance company.
- No matter who is at fault, your insurance company is responsible for medical expenses incurred because of your injuries.
- If you have other health care coverage (e.g., Blue Cross, HealthPlus of Michigan), they may be responsible to pay first.
- Your medical benefit is continuous for the rest of your life, whether you change insurance companies or not.
- The medical benefit covers all forms of "medical care" (e.g., surgery, therapy, doctor visits, dental care, prosthetic devices, prescription co-pays).
- You have a right to help in your home, if you are unable to do the normal things done prior to car accident. Currently this benefit is up to $20.00 per day.
- Your doctor must agree that you need help and provide a statement to this effect.
- Family members qualify for the payment of this help.
- You have a right to be paid gasoline mileage for trips to the doctor.
- You may have the right to "in home" nursing care.
- You must send all requests for payment of benefits and medical bills to your own insurance company within one year of the date you incurred the expense. If not sent in, the insurance company won't pay as they should.
WARNING:
Even if your bills and requests for reimbursement are sent to the insurance company as prescribed, if they fail to pay within one year (for any reason; even their fault), you will not get reimbursed IF A LAW SUIT HAS NOT BEEN FILED WITHIN THAT ONE YEAR PERIOD.
-
- If you forget that you have not been paid;
- If they lose your paperwork;
- If they deny your requests;
- If they forget to pay you, etc.
